Terms of Service for Hava

1. Acceptance

By using Hava (havasuchat.com — the website, chat, directory, and events listings), you agree to these Terms of Service. If you do not agree, please do not use the service. Our Privacy page explains how we collect and use information; it is part of your agreement with us when you use Hava.

2. What Hava is

Hava is a free local guide for the Lake Havasu City area: a directory of local businesses and services, a calendar of local events and programs, and an AI chat concierge ("Ask Hava") that answers questions about town. It is run by a small, independent local operator — not a big company and not a government agency.

Hava is not professional advice. We are not a lawyer, doctor, financial advisor, or emergency service. If you are in danger or need official help, contact the appropriate emergency or government services, not this site.

3. AI answers can be wrong

The chat concierge uses artificial intelligence to generate its answers. AI makes mistakes. Answers may be incomplete, out of date, or simply wrong — about hours, prices, locations, events, or anything else. We make no warranty about the accuracy of chat answers or directory listings. Before you drive across town, spend money, or make any decision that matters, confirm the details directly with the business, venue, or official source. We are not responsible for losses caused by relying on information from the service.

4. Accounts

Most of Hava works without an account. We offer an optional email sign-in for features like saving favorites and managing alerts, and for business owners claiming or managing a listing. Keep your sign-in email accurate; you are responsible for activity under your account. We may suspend or close accounts that violate these terms.

5. Using the service

5.1 Acceptable use. Use the service in a normal, human way: ask questions, browse listings, and submit suggestions you believe are accurate. Do not use scripts, bots, or automated tools to scrape the site, bulk-download data, or generate traffic meant to stress or break the service. Do not try to get around rate limits, security measures, or spam controls. Do not use the service for anything illegal, harmful, harassing, or designed to deceive others. Do not submit false or intentionally misleading information through the chat or the contribution form. We may block, throttle, or refuse service to anyone who abuses these rules.

5.2 Technical limits. The service enforces rate limits and other automatic protections, and we may adjust them over time. They exist to keep the service reliable for everyone, not to restrict normal use.

6. Your contributions

6.1 What you can submit. You may use the contribute flow to suggest businesses, events, programs, and tips you think belong in the catalog, along with any description, photo, or link the form asks for. Submit information you believe to be truthful, in good faith, and appropriate for a general audience.

6.2 License to use submissions. You keep ownership of what you contribute. By submitting, you grant us a non-exclusive, worldwide, royalty-free license to store, review, edit, display, and incorporate your submission into the Hava website and related materials (the public catalog, administrative tools, and backups) for as long as we run the service. This license is what lets us read your suggestion, decide if it fits, and show it to others if we accept it.

6.3 No guarantee of inclusion. Nothing you submit is guaranteed to appear in the catalog. A human reviews contributions, and we may reject, edit, delay, or remove entries for any reasonable reason — quality, fit, accuracy, duplication, spam, legal or safety risk, or operational needs.

6.4 Your representations. You represent that you have the right to submit the content you send, that it does not violate anyone else's rights, and that you are not impersonating another person or business.

7. Business listings, claims, and sponsorships

7.1 Free listings. Directory listings are compiled from public sources and community contributions. A listing on Hava is free and does not mean the business endorses us or that we endorse the business.

7.2 Claims. Business owners (or their authorized representatives) can claim a listing to manage its details. Claims are reviewed by a human, and we may ask for verification. Do not claim a business you are not authorized to represent. We may revoke a claim that turns out to be false or abusive.

7.3 Paid placements. Some businesses pay for promotional placement (for example, a "Spotlight" slot). Paid placements are always labeled so you can tell them apart from organic results. Payment does not change the chat concierge's organic recommendations and does not buy a better rating, ranking, or review.

7.4 No guarantee of results. Sponsorships and paid placements buy visibility on the site, not outcomes. We make no promise of clicks, calls, customers, or revenue from any placement. We may decline or end a sponsorship that conflicts with these terms or with what is good for the people who use the site; if we end a prepaid placement early for our own reasons, we will refund the unused portion.

8. Analytics and privacy

We use Plausible, a privacy-focused analytics tool, to count page views and understand which features get used. It does not use cookies and does not build persistent profiles of individual visitors. We do not sell personal data and we do not run third-party ad trackers. Details — including what the chat stores and which AI providers process your messages — are on our Privacy page.

9. Information and accuracy

Hours, prices, schedules, and locations change constantly in a seasonal town. The catalog and the concierge's answers are not guaranteed to be complete, current, or error-free (see §3). If you spot something wrong, please tell us — the feedback control in the chat or hello@havasuchat.com is the fastest route.

10. Intellectual property

The Hava name, the site's design, and the curated catalog we operate belong to us. You may not copy, scrape, or reuse the database, bulk data, or site structure to build a competing product without permission. Your own contributions stay yours, subject to the license in §6.

Some catalog information is enriched or cross-checked using third-party sources (for example, business listing services). That third-party data remains subject to those parties' own terms, and you are not granted any separate license to it beyond what you see through our service.

11. Disclaimers and limitation of liability

Hava is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent allowed by law. We do not warrant that the service will be uninterrupted, error-free, or free of harmful code.

To the fullest extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or exemplary damages, or for lost profits, data, or goodwill, arising from your use of (or inability to use) the service. Our total aggregate liability for all claims related to the service is limited to the greater of one hundred U.S. dollars ($100) or the amount you paid us for the service in the twelve months before the claim arose.

Some jurisdictions do not allow certain warranty disclaimers or liability limits. If that applies to you, those limits apply only to the extent the law allows, and you may have additional rights.

12. Changes to these terms

We may update these Terms of Service from time to time. When we do, we will post the new version on this page and change the "Last updated" date at the top. If the changes are material, we may also use other reasonable ways to let you know. Continued use of Hava after updated terms are posted means you accept the new terms; if you do not agree, stop using the service.

13. Governing law

These terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law rules. Disputes arising from or related to the service will be brought in the state or federal courts located in Arizona, and you consent to venue there, to the extent the law allows.

15. Reporting problems with catalog content

If you believe something in the public catalog is inaccurate, offensive, or infringes your or someone else's rights (including copyright), email hello@havasuchat.com with a link to the page and a short description of the problem. We review reports as quickly as we reasonably can and may remove or change content that violates these terms, is wrong in a way that could harm users, or is otherwise inappropriate for the service. This is a small, manually operated project; we do not promise a particular turnaround time, but takedown requests from rights holders are treated as a priority.
